DroneMe Terms of Service

Article 1 (Application)

1. These Terms apply to all relations concerning the use of the application "DroneMe" (the "Service") provided by DroneMaker ("we", "us", or "our").

2. You are deemed to have agreed to these Terms by using the Service.

Article 2 (Definitions)

The terms used in these Terms are defined as follows.

1. "User" means an individual who uses the Service having agreed to these Terms.

2. "Operator" means a User who consumes Points on the Service to request and view a video stream from a Drone.

3. "Drone" means a User who streams video from their own camera on the Service and receives Points in return.

4. "Points" means the value usable within the Service that is granted by methods we prescribe. Points may be displayed as "pt" within the Service.

5. "Balance" means the total quantity of Points held by a User.

6. "Beacon" means a display of a target location placed on the map by an Operator through the consumption of Points.

7. "App Store" means Google Play, the App Store, and other application distribution platforms that serve as the basis for the distribution of, and payment for, the Service.

Article 3 (Accounts)

1. The Service issues accounts by anonymous authentication.

2. You are responsible for the management of your account.

3. By carrying out account linking (meaning registration of a Google account, an email address, or another login method we prescribe; hereinafter the same) by a method we prescribe, you may carry over the Balance and other data associated with your account after changing devices or reinstalling the application.

4. Where account linking has not been carried out and account information is lost due to deletion (uninstallation) of the application, a change of device, initialization of a device, or any other cause, the Balance and other data associated with that account will be lost and cannot be restored. In such case, we will provide no refund, compensation, or any other remedy for the lost Balance or other data. You acknowledge this in advance.

5. The Service may be used only by persons aged 18 or over. Persons under the age of 18 may not use the Service.

Article 4 (Points)

1. You may acquire Points by methods we prescribe.

2. Purchases of Points for consideration shall be made by means of the in-app purchase method provided by the App Store. The procedures and conditions for payment shall be governed by the rules of the relevant App Store.

3. We may make the completion of account linking or other procedures we prescribe a condition for the purchase of Points for consideration.

4. The unit price of Points and other conditions shall be as displayed within the Service.

5. Points purchased through Google Play, and Points we grant free of charge (including bonuses for registration, login, and installation, grants under campaigns, and distributions via Beacons), shall expire six (6) months from the date of issue of such Points. Points that have passed their expiry date lapse and can no longer be used. No expiry date is set for Points purchased through the App Store or for Points granted as consideration for connection as a Drone (Article 5).

6. Except in cases of lapse or as otherwise provided in these Terms, Points may be used only within the Service.

7. Except where permitted by law, no refund of acquired Points will be made. Whether a refund relating to payment is available, and the procedures therefor, shall be governed by law and by the rules of the relevant App Store.

8. Points may not be used for any purpose other than those we prescribe within the Service, and may not be transferred, lent, pledged, or otherwise disposed of to any third party.

Article 5 (Consumption and Grant of Points)

1. When an Operator connects to a Drone (views a video stream), the Operator's Points are consumed at the rate we prescribe according to the connection time.

2. The Drone is granted Points at the rate we prescribe in respect of such connection.

3. Each rate shall be as displayed within the Service, and we may change it as necessary.

4. Points granted to a Drone may be used only within the Service and cannot be exchanged for cash or any other value (no cash conversion or withdrawal).

5. Where the connection time is less than 10 seconds, the consumption and grant of Points shall be calculated as if the connection time were 10 seconds.

Article 6 (Beacons)

1. An Operator may consume Points to place a Beacon on the map and thereby encourage other Users (Drones) to reach that location.

2. The number of Points required to place a Beacon, the display period, and other conditions shall be as displayed within the Service, and we may change them as necessary.

3. Only one Beacon may be placed at a time per User, and the display period cannot be changed after placement.

4. The Points consumed shall be distributed in full and in equal shares to the first three Drones who reach the area surrounding the Beacon (within the range we prescribe) within the display period. Any fraction arising in the distribution shall be rounded down and shall lapse.

5. No return of Points will be made after placement. The same applies where no Drone reaches the location within the display period, in which case the Points consumed shall lapse in full.

6. Determination of arrival is made based on location information received by our servers. Errors may arise in such determination due to technical factors, and you acknowledge this in advance.

7. The expiry date of Points distributed via a Beacon shall be as provided in Article 4, Paragraph 5.

8. You must not receive a distribution of Points by falsifying location information, by reaching your own Beacon, by reaching a Beacon in collusion with another User, or by any other improper means. If impropriety is found, we may cancel the distributed Points, suspend the account, and take any other necessary measures.

9. Whether to attempt to reach a Beacon is at the free discretion of the Drone. Drones shall comply with traffic laws and other laws and regulations when travelling, and shall ensure their own safety. Operators must not place a Beacon for the purpose of encouraging entry into places where entry is prohibited or other dangerous places.

Article 7 (Measurement of Call Time and Determination of Charges)

1. The measurement of call time may involve an error of several seconds due to communication conditions or other technical factors.

2. Where a call ends upon detection of a disconnection, the end point of the chargeable time shall be determined on the basis of the last time at which our servers confirmed liveness.

3. The call time displayed on a device (such as in a summary display) is a value measured on the device side and may differ from the chargeable time determined under the preceding two paragraphs. The consumption and grant of Points shall be based on the values determined on the server side.

Article 8 (Recording of Video)

1. An Operator may record the video stream (including audio) of a connected Drone on their own device.

2. Recorded data is stored only within that Operator's device. We do not obtain or store recorded data.

3. Drones consent in advance to the possibility that their own stream may be recorded by an Operator.

4. Operators must not use recorded data beyond the scope of private use, and must not publish, distribute, or otherwise handle it in a manner that infringes the rights of Drones or any third party.

5. The Operator who made the recording bears all responsibility for the retention, management, and use of the recorded data.

Article 9 (Prohibited Acts)

You must not engage in any of the following acts in using the Service.

1. Acts that violate laws and regulations or public order and morals

2. Acts related to criminal conduct

3. Acts that infringe the video, likeness, privacy, portrait rights, copyright, or other rights of others

4. Video streaming in a place or by a method where filming is prohibited, or video streaming carried out by entering a place where entry is prohibited or any other dangerous place

5. Streaming of obscene, violent, discriminatory, or otherwise inappropriate video

6. Use of the Service for the purpose of surreptitious filming or otherwise harming the rights or interests of others

7. Acts of tracking or stalking a particular User by misusing location information

8. Acts of publishing recorded data, or providing it to a third party, without the consent of the person concerned

9. Acts of placing a Beacon for an improper purpose, or receiving a distribution of Points by improper means

10. Acts that obstruct the operation of the Service

11. Acts of acquiring or using Points by improper means

12. Any other act that we deem inappropriate

Article 10 (User Responsibility for Safety)

1. You bear responsibility for ensuring your own safety and that of third parties in using the Service.

2. Drones shall comply with traffic laws and other laws and regulations, and pay careful attention to the safety of their surroundings, including when streaming while moving.

3. We shall not be liable for any dispute, damage, or accident arising between Users or between a User and a third party, except in cases of our intentional misconduct or gross negligence.

4. We shall bear no liability whatsoever for damage caused to a User or a third party as a result of a User's breach of these Terms, except in cases of our intentional misconduct or gross negligence.

Article 11 (Suspension or Modification of the Service)

We may suspend or modify all or part of the provision of the Service without prior notice to Users in the following cases.

1. Where maintenance, inspection, or updating of the Service is carried out

2. Where provision of the Service becomes difficult due to natural disaster or other force majeure

3. Where we otherwise deem suspension or modification necessary

Article 12 (Withdrawal by Users)

1. You may withdraw from the Service by a method we prescribe.

2. Points held at the time of withdrawal shall not be subject to refund and shall be extinguished, except where permitted by law.

Article 13 (Suspension or Deletion of Accounts and Deletion of Displayed Content)

1. Where we determine that a User has breached these Terms, we may suspend or delete that User's account without prior notice. In such case, any Points remaining in the account shall be extinguished and no refund will be made.

2. We may stop the streaming of video that breaches these Terms or that we deem inappropriate, and may delete or modify, without prior notice, textual information displayed on the Service by a User (such as display names and messages attached to Beacons).

Article 14 (Disclaimer)

1. We make no warranty, express or implied, that the Service is free from defects in fact or in law.

2. We shall not be liable for damage caused to a User arising from the Service, except in cases of our intentional misconduct or gross negligence.

3. Even where we bear liability for damages, the amount of compensation shall be limited to the amount paid by that User to us during the immediately preceding one (1) month.

4. We do not warrant that the Service will operate without interruption or error. Even where the Service fails to operate properly, or a User suffers damage, due to interruption, suspension, termination, or modification of the provision of the Service, a communication failure, a defect in the User's device or in an external service, or any other cause, we shall bear no liability whatsoever, except in cases of our intentional misconduct or gross negligence.

Article 15 (Changes to These Terms)

We may change these Terms without notice to Users where we deem it necessary. The changed Terms shall take effect from the time they are displayed on the Service.

Article 16 (Language)

1. The Japanese text of these Terms is the authoritative version.

2. Even where we provide a translation of these Terms, such translation is for reference only, and in the event of any discrepancy between the translation and the Japanese version, the Japanese version shall prevail.

Article 17 (Governing Law and Jurisdiction)

1. These Terms shall be interpreted in accordance with the laws of Japan.

2. In the event of a dispute concerning the Service, the court having jurisdiction over our location shall have exclusive agreed jurisdiction.
